Terms & Conditions
HAUTE KITCHENS
TERMS & CONDITIONS FOR THE SUPPLY AND INSTALLATION OF KITCHENS
Last updated: August 2026
These Terms & Conditions apply to the supply of kitchens, kitchen products and, where applicable, installation and associated services by Haute Kitchens.
These Terms do not affect your statutory rights under the Consumer Rights Act 2015 or other applicable consumer legislation.
1. DEFINITIONS
In these Terms:
“Customer”, “you” or “your” means the person named on the quotation/order who purchases Goods and/or Services from Haute Kitchens.
“Haute Kitchens”, “we”, “us” or “our” means Haute Kitchens.
“Contract” means the agreement between you and Haute Kitchens consisting of your signed Order, these Terms & Conditions and the documents incorporated into the Order.
“Goods” means the kitchen furniture, doors, drawers, panels, worktops, appliances, accessories and other products specified in your Order.
“Services” means any design, survey, delivery, installation or associated services expressly included within your Order.
“Order” means the kitchen and/or Services you have agreed to purchase from Haute Kitchens.
“Bespoke Goods” means Goods manufactured, cut, finished, configured or otherwise ordered specifically to your measurements, design choices or individual requirements.
References to “writing” include email and other written electronic communication where appropriate.
2. YOUR CONTRACT WITH HAUTE KITCHENS
These Terms & Conditions apply to all Goods and Services supplied by Haute Kitchens.
2.2
Before signing the Order, the customer must check that the brief order description, principal product selections, total agreed price and payment terms recorded on the Order accurately reflect what has been discussed and agreed.
2.3
The Contract is finalised when the customer signs the Haute Kitchens Order & Payment Receipt. The Contract may consist of:
-
the signed Order & Payment Receipt;
-
these Terms & Conditions;
-
the itemised quotation;
-
the kitchen order confirmation;
-
the product and specification schedule;
-
the appliance list, where applicable;
-
any kitchen designs or plans supplied in connection with the Order;
-
all other documents subsequently emailed by Haute Kitchens confirming what was discussed and agreed; and
-
any later written variation accepted by both parties.
2.4
The documents emailed after signing are supplied as the complete written record of the Order and do not create a new change-of-mind cancellation or approval period. The customer must contact Haute Kitchens immediately if an emailed document does not accurately record what was agreed at the appointment.
2.5
Where an administrative or recording error is identified, Haute Kitchens will take reasonable steps to correct the document so that it accurately reflects the agreement made when the Order was signed. This is different from a customer requesting a change to the agreed Order.
2.6
Any later change to the agreed Contract must be accepted by Haute Kitchens in writing. Additional Goods, alterations or work may incur additional charges and may affect delivery or installation dates.
2.7
Nothing in this section excludes liability for fraudulent misrepresentation or affects any consumer right that cannot legally be excluded.
Statements or promises which do not appear within the Contract or a subsequently agreed written amendment should not be relied upon as changing the agreed specification.
Nothing in this clause excludes liability for fraudulent misrepresentation or any liability which cannot lawfully be excluded.
3. BESPOKE AND MADE-TO-MEASURE KITCHENS
3.1
Haute Kitchens specialises in individually designed kitchens.
Kitchen furniture and associated components may be manufactured, cut, finished, configured or specifically ordered according to your individual:
measurements;
layout;
cabinet configuration;
door style;
colour;
finish;
handles;
panels;
worktops;
appliances; and
other agreed preferences.
3.2
You therefore understand that some or all of the Goods forming your kitchen may constitute bespoke or made-to-measure Goods manufactured or ordered specifically for you.
3.3
Because Bespoke Goods are manufactured or ordered for an individual customer, they may have little or no reasonable resale value to Haute Kitchens.
3.4
This does not affect your statutory rights where Goods are faulty, incorrectly supplied, not as described or otherwise fail to conform to the Contract.
4. ORDER APPROVAL
4.1
By signing the Order & Payment Receipt, the customer confirms that the brief order description, principal selections, total price and payment terms are correct and that they wish Haute Kitchens to proceed with the Order.
4.2
Haute Kitchens will email the customer the complete written order documentation, which may include the itemised quotation, product specification, appliance list, design documents, scope of installation work and any relevant exclusions.
4.3
The emailed documents confirm and record the complete Order and everything discussed and agreed. They form part of the Contract together with the signed Order & Payment Receipt and these Terms & Conditions.
4.4
The customer must notify Haute Kitchens immediately if they believe an emailed document contains a genuine administrative error or does not accurately record what was agreed.
4.5
A correction made solely to reflect the original agreement is not treated as a customer-requested change. Any request to alter the agreed style, colour, finish, layout, appliances, worktops, products or installation work will be dealt with under section 6.
4.6
Where Haute Kitchens takes responsibility for surveying and measuring the installation area, those services will be performed with reasonable care and skill.
4.7
Where measurements, dimensions or plans are supplied by the customer or another contractor, the customer is responsible for their accuracy unless Haute Kitchens subsequently surveys and approves them.
5. PLACING YOUR BESPOKE MANUFACTURING ORDER
5.1 Unless otherwise agreed in writing, Haute Kitchens normally submits the customer’s agreed bespoke kitchen order to the manufacturer or relevant suppliers on the next working day after the Order & Payment Receipt is signed.
5.2
Once the manufacturing/supplier order has been submitted, manufacture, allocation of materials and/or procurement of customer-specific Goods may begin.
5.3
The customer should not sign the Order until satisfied that they wish to proceed and that the brief order description, principal product selections, total price and payment terms are correct.
6. CHANGES AFTER SIGNING
6.1
If you identify an error or wish to request a change after signing, you should contact Haute Kitchens immediately.
6.2
Before the manufacturing order has been submitted, we will consider whether the requested amendment can reasonably be accommodated.
6.3
Once an order has been submitted for bespoke manufacture or customer-specific Goods have been ordered, Haute Kitchens cannot guarantee that any alteration can be made.
6.4
Where a requested alteration can be accommodated, it may result in:
additional product costs;
manufacturer charges;
administration costs;
additional delivery costs;
additional labour costs; and/or
changes to the anticipated delivery or installation date.
6.5
Any agreed alteration and its price will be recorded in writing.
Additional work or Goods requested by the customer are not included within the original Contract price unless expressly stated.
7. PRICE
7.1
The total agreed price for your Goods and Services will be stated on your quotation and Order.
7.2
The quoted price covers only those Goods and Services expressly included within your quotation and Order.
7.3
Additional Goods, alterations or works requested after the Contract has been agreed will be charged separately where applicable and agreed with you before proceeding.
8. INITIAL PAYMENT AND PAYMENT TERMS
8.1
Unless an alternative arrangement is expressly recorded on your Order, an initial payment equal to 50% of the total agreed Contract price is payable when the Order is signed.
8.2
The amount of the initial payment will be clearly shown on your Order documentation.
8.3
The remaining balance and any applicable staged payments will be shown on the Order documentation.
8.4
Payments may be made by:
cash;
bank transfer;
debit card; or
credit card.
8.5
Payments must be made by the dates specified on your Order.
8.6
Where payment is required before delivery, cleared funds must be received before delivery takes place.
8.7
Where an outstanding payment has not been received when due, Haute Kitchens may postpone delivery and/or installation until payment has been received, subject to any rights you may have where an amount is genuinely disputed.
8.8
Any additional Goods or works subsequently requested by you will be separately recorded and charged as agreed.
9. INITIAL PAYMENT AND CANCELLATION
9.1
Your kitchen is individually designed and Bespoke Goods may be manufactured or ordered specifically for your project.
9.2
Where applicable law gives you a cancellation right, nothing within these Terms removes that right.
9.3
Once your bespoke manufacturing/supplier order has been submitted, your initial payment becomes non-refundable to the extent permitted by law, reflecting the customer-specific Goods, commitments, costs and losses reasonably incurred or committed by Haute Kitchens as a consequence of your Order.
9.4
Where a customer requests cancellation before the bespoke manufacturing/supplier order has been submitted, Haute Kitchens will deal with the cancellation in accordance with the customer's applicable statutory rights and any reasonable costs or losses lawfully recoverable.
9.5
Bespoke or made-to-measure Goods may be excluded from statutory change-of-mind cancellation rights in circumstances provided for by consumer legislation.
9.6
Nothing within this section affects your statutory rights where Goods are faulty, not as described or otherwise fail to conform to the Contract, or where Services have not been performed in accordance with applicable consumer law.
10. DELIVERY
10.1
Haute Kitchens will provide an anticipated delivery date or period once reasonably available.
10.2
Delivery dates may depend upon manufacturing schedules, product availability, appliance availability, worktop manufacture, transport and other factors.
10.3
We will make reasonable efforts to meet agreed dates and will inform you of material delays of which we become aware.
10.4
The customer must provide suitable and safe access for delivery.
You should tell us in advance about:
restricted parking;
narrow entrances;
stairs;
access restrictions;
unusual delivery requirements; or
anything else reasonably likely to interfere with delivery.
10.5
Where delivery cannot reasonably take place because the customer has failed to provide agreed access or the property is not ready, reasonable additional delivery, storage or labour costs caused by this may be charged to the customer where appropriate.
11. INSTALLATION
11.1
Installation is included only where expressly stated within your quotation and Order.
11.2
The precise scope of installation work will be determined by your Contract.
11.3
Unless expressly included in writing, the Contract does not automatically include unrelated or additional:
structural alterations;
extensive plastering;
flooring;
decorating;
remedial building works;
asbestos removal;
specialist electrical work;
specialist gas work;
specialist plumbing work; or
correction of pre-existing defects.
11.4
Where specialist electrical or gas work forms part of our agreed Services, it will be undertaken by appropriately competent and, where legally required, registered tradespeople.
11.5
Where installation is arranged through Haute Kitchens, the Services will be carried out with reasonable care and skill.
12. CUSTOMER RESPONSIBILITIES
Unless otherwise expressly agreed in writing, you are responsible for:
providing clear and reasonably safe access to the property;
removing personal possessions from the working area;
ensuring that relevant utilities can safely be isolated where necessary;
informing us of known hidden pipes, wiring, defects or structural concerns;
informing us about access restrictions;
ensuring children, pets and other occupants are kept reasonably clear of the working area;
obtaining any necessary landlord, freeholder or other property-owner consent; and
carrying out any preparatory works specifically allocated to you within the Contract.
13. HIDDEN AND UNFORESEEN SITE CONDITIONS
13.1
Kitchen removal and installation can reveal conditions which could not reasonably have been identified during an ordinary pre-installation inspection.
Examples may include:
concealed pipework;
concealed electrical wiring;
defective electrics;
defective plumbing;
water damage;
damp;
rotten flooring;
uneven or defective walls or floors;
structural defects;
asbestos or suspected asbestos-containing materials; or
previous building work that does not permit the agreed installation to proceed safely.
13.2
Haute Kitchens is not responsible for the cost of correcting pre-existing or concealed property defects merely because they become apparent during the project.
13.3
Where additional work is reasonably required, we will explain the issue to you.
Where reasonably practicable, additional chargeable work will not be undertaken until its scope and price have been agreed with you.
13.4
You may alternatively arrange appropriate remedial work yourself, provided this is carried out safely and does not unreasonably interfere with the agreed installation programme.
13.5
Discovery of unforeseen conditions may result in the installation programme being extended.
14. THIRD-PARTY TRADES AND CUSTOMER-ARRANGED WORK
14.1
Where you appoint your own builder, electrician, plumber, fitter or other tradesperson, Haute Kitchens is not responsible for the quality or performance of work carried out by that independent third party.
14.2
Where another contractor's work affects our ability to install the kitchen correctly or safely, we may suspend the affected part of our Services until the problem has been resolved.
14.3
Any additional attendance or work required from Haute Kitchens as a result may be chargeable where reasonable.
15. PRODUCT APPEARANCE AND VARIATION
15.1
Website photographs, brochures, computer-generated designs and visualisations are intended to assist customers in visualising products and designs.
15.2
Screen settings, photography, lighting and printing can affect the appearance of colours and finishes.
15.3
Natural and manufactured materials may contain reasonable variations in:
colour;
grain;
veining;
pattern;
texture; and
tone.
15.4
Painted finishes can also display reasonable variations between batches and under different lighting conditions.
15.5
Reasonable natural or manufacturing variation is not in itself a defect.
This does not affect your rights where Goods fail to correspond with their description, specification or any sample/model relied upon as required by law.
16. APPLIANCES
16.1
Where appliances are supplied by Haute Kitchens, the make and model will normally be identified within your appliance list or Order documentation.
16.2
Appliances may be supplied with manufacturer guarantees or warranties.
16.3
Customers may be required to register appliances with the manufacturer to obtain additional manufacturer warranty benefits.
16.4
Manufacturer guarantees are additional to and do not replace your statutory consumer rights against Haute Kitchens where those rights apply.
16.5
If an appliance develops a fault, please contact Haute Kitchens and/or follow any manufacturer support procedure we provide. Nothing in such a procedure removes Haute Kitchens' legal responsibilities as the retailer where applicable.
17. GUARANTEES
17.1
Kitchen furniture supplied by Haute Kitchens carries the manufacturer’s applicable six-year guarantee, subject to the manufacturer’s guarantee conditions, exclusions and care requirements.
17.2
Appliances carry their applicable individual manufacturer guarantees. The customer may need to register appliances with the relevant manufacturer to receive additional guarantee benefits.
17.3
Haute Kitchens provides a 12-month installation-workmanship guarantee commencing on completion of the installation. This covers defects directly caused by installation work included within the Haute Kitchens Contract.
17.4
The installation-workmanship guarantee does not cover:
-
accidental damage or misuse;
-
ordinary wear and tear;
-
natural movement of the property;
-
hidden or pre-existing property defects;
-
faults in customer-supplied products;
-
damage caused by inadequate maintenance;
-
manufacturer or product defects; or
-
work subsequently altered, repaired or interfered with by another person.
17.5
The customer should notify Haute Kitchens promptly after discovering a potential guarantee issue and allow a reasonable opportunity for the matter to be inspected and, where Haute Kitchens is responsible, remedied.
17.6
Manufacturer and workmanship guarantees are additional to the customer’s statutory rights and do not replace or restrict those rights.
18. FAULTY, DAMAGED OR INCORRECT GOODS
18.1
Haute Kitchens is under a legal duty to supply Goods that conform to the Contract.
18.2
If you believe Goods are damaged, faulty, missing, incorrectly supplied or not as described, please notify us as soon as reasonably practicable after discovering the issue.
18.3
We may need to inspect the Goods or obtain information, photographs or manufacturer assistance to determine the appropriate remedy.
18.4
Where required by consumer law, an appropriate remedy will be provided.
Nothing within these Terms restricts your statutory rights under the Consumer Rights Act 2015.
19. COMPLETION, INSPECTION AND SNAGGING
19.1
Following installation, you will be given the opportunity to inspect the kitchen and identify any visible outstanding items.
19.2
Where applicable, Haute Kitchens may provide a Completion & Handover Form recording:
completion status;
visible snagging items;
outstanding products or remedial works;
relevant appliance information;
payments;
customer comments; and
customer and Haute Kitchens signatures.
19.3
Minor snagging items which do not prevent reasonable use of the kitchen will not necessarily mean that installation has not been substantially completed.
19.4
Any agreed outstanding items will be recorded and dealt with within a reasonable period, taking account of replacement-product manufacturing and supplier lead times.
19.5
Signing a Completion & Handover Form does not remove your statutory rights in relation to defects or other issues subsequently discovered.
20. CUSTOMER-REQUESTED DELAYS
20.1
Once manufacturing, delivery and installation arrangements have been made, changes requested by the customer may result in additional costs.
20.2
If you need to postpone an agreed delivery or installation date, you should give Haute Kitchens as much notice as reasonably possible.
20.3
Where your postponement results in unavoidable and reasonable additional storage, delivery, contractor or other costs, we may charge those costs to you after explaining them.
21. DELAYS AND EVENTS OUTSIDE OUR REASONABLE CONTROL
21.1
Circumstances outside Haute Kitchens' reasonable control can occasionally delay manufacture, supply, delivery or installation.
These may include serious transport disruption, supplier or manufacturer disruption, extreme weather, utility interruption, industrial action, government restrictions or other circumstances that could not reasonably have been prevented.
21.2
Where such circumstances materially affect your project, we will contact you as soon as reasonably practicable and take reasonable steps to minimise the impact.
21.3
Any legal rights you have because of a significant or prolonged delay are unaffected by this clause.
22. DAMAGE TO THE PROPERTY
22.1
Where installation is provided by Haute Kitchens, reasonable care will be taken when working within your property.
22.2
Where we or persons for whom we are legally responsible negligently cause damage to your property, we will be responsible for putting that damage right where legally required.
22.3
We are not responsible merely because pre-existing damage, hidden defects or defective previous workmanship become apparent during removal or installation.
23. OWNERSHIP OF GOODS
Where permitted by law, ownership of Goods supplied under the Contract will remain with Haute Kitchens until the amounts properly due for those Goods under the Contract have been paid in full.
This clause does not affect the allocation of risk or any consumer rights arising under applicable law.
24. OUR LIABILITY
Nothing within these Terms excludes or limits Haute Kitchens' liability where it would be unlawful to do so, including liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
breach of applicable statutory consumer rights; or
any other liability which cannot lawfully be excluded or restricted.
Where we are legally responsible for foreseeable loss or damage caused by our breach of the Contract or negligence, we will remain responsible in accordance with applicable law.
Haute Kitchens is not responsible for losses arising solely from circumstances for which the customer or an independent third party is responsible.
25. CANCELLATION BY HAUTE KITCHENS
25.1
In exceptional circumstances Haute Kitchens may need to cancel all or part of a Contract where we are genuinely unable to supply the relevant Goods or Services.
25.2
If we cancel Goods or Services which you have paid for but which have not been supplied, we will refund the relevant amount where required.
25.3
We may also suspend or terminate performance where the customer:
fails to make a payment properly due;
prevents us from carrying out the agreed Services;
creates an unsafe working environment; or
commits a serious breach of the Contract and, where capable of remedy, fails to remedy it within a reasonable period after being asked to do so.
Any exercise of these rights will be subject to applicable consumer law.
26. COMPLAINTS
We want customers to be delighted with their Haute Kitchens experience.
If something is not right, please contact us promptly so that we have an opportunity to investigate and resolve the matter.
Please provide:
your name;
installation address;
order or quotation reference where available;
details of the issue; and
photographs or other supporting information where relevant.
We will investigate complaints fairly and aim to keep you informed while the matter is being considered.
Further information is available within our Complaints Policy.
27. PERSONAL INFORMATION
We will process personal information in accordance with applicable UK data protection legislation and our Privacy Policy.
Information may be shared with manufacturers, suppliers, delivery providers, installers, tradespeople, payment providers and other parties where reasonably necessary to fulfil your Contract.
We do not sell customer personal information.
Please see our Privacy Policy for further information.
28. THIRD-PARTY RIGHTS
The Contract is between you and Haute Kitchens.
Unless applicable law provides otherwise, no other person has the right to enforce its terms.
29. IF PART OF THESE TERMS IS INVALID
Each provision of these Terms operates separately.
If a court or other competent authority determines that any provision is unlawful or unenforceable, the remaining provisions will continue to apply.
30. DELAY IN ENFORCING THESE TERMS
If Haute Kitchens does not immediately enforce a right under the Contract, this does not necessarily mean that we have waived that right.
31. GOVERNING LAW
These Terms and your Contract with Haute Kitchens are governed by the applicable laws of England and Wales.
Nothing in this clause deprives a consumer resident elsewhere in the United Kingdom of any mandatory rights or jurisdiction protections available to them under applicable law.

-
They wish to enter into the Contract and authorise Haute Kitchens to proceed with the agreed Order.
-
All remaining documents confirming the complete Order and everything discussed and agreed will be supplied separately by email and will form part of the Contract.
-
The emailed documents record and confirm the agreement already made and do not create a new change-of-mind cancellation or approval period.
-
Haute Kitchens normally submits the made-to-order kitchen to the manufacturer or relevant suppliers on the next working day after signing.
-
Once the bespoke manufacturing or supplier order has been submitted, changes or cancellation for a change of mind may not be possible.
-
Additional Goods or alterations requested after signing may incur additional costs and may affect delivery or installation dates.
-
Nothing within the Contract affects the customer’s statutory rights where Goods are faulty, incorrectly supplied, not as described or otherwise fail to conform to the Contract, or where Services are not performed with reasonable care and skill.
